If your organization collects or processes personal data from European Union citizens and you do not have an office in the EU, then you probably will need to designate, in writing, an EU Representative.
 
A controller or processor of personal data, not established in the European Union (EU), but subject to the General Data Protection Regulation (GDPR), which fails to designate a representative in the EU would therefore be in breach of the Regulation.
This is also the case for organizations in the UK now the transitional period after Brexit has ended, since the end of 2020.
 
For companies that have business activities in Switzerland and processing personal data collected in Switzerland   a representation is in general not mandatory, but recommended. On the other hand Controllers with their domicile or residence abroad must designate a representative in Switzerland if they fulfil the requirements of Article 14 of the New Federal Act on Data Protection.
